  Intellectual Property Protection Laws

Under the Oslo Agreement, the PNA was required to use its best efforts to adopt legislation for the protection of intellectual property compatible with the provisions of the GATT (Related Aspects of Intellectual Property) including an adequate system of examination and registration of applications for trade-marks, copyrights, and patents.

The legal mechanisms in place for the registration and the protection of intellectual property (trademarks, patents, copy-rights, brand-names, and commercial-names) are working sufficiently in the Palestinian Territories to provide adequate protection of such rights in court under the following laws:- Trade-Marks Laws ( Law No. 33 / 1952 in WB and Law No. 35 / 1938 in GS) ; Patents Laws ( Law No. 22 / 1953 in WB and 1925 Law in GS) ; Commercial-Names Laws (Law No. 30 / 1953 in WB and Law No. 23 / 1935 in GS ) ; Copy-Rights Laws ( 1924 Law inPalestinian Territories ) ; Brand-Names Laws ( Law No. 19 / 1952 in WB and 1929 Law in GS).

The PLC is in the process of legislating new laws for the protection of intellectual property in Palestine . The passing of the “Arbitration Law” (Law No. 3 / 2000) by the PLC is an important step for the additional protection of registered intellectual property in Palestine .
